1. Parties & Acceptance
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User") and Verhaeghe, a micro-entreprise registered in France, operating under the trade name Be French, located at 9 La Tierais, 35630 Saint-Brieuc-des-Iffs, France ("Be French", "we", "us", or "our").

By installing the Be French Chrome Extension, creating an account, or accessing any part of the Be French platform, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must immediately stop using the Service.

2. Description of Service
Be French is a paid Software-as-a-Service (SaaS) platform designed to help learners acquire French through immersion-first vocabulary and sentence mining from native content, primarily YouTube and Netflix. The Service includes:
- A Chrome Extension that overlays interactive subtitles on YouTube videos and Netflix.
- A Spaced Repetition System (SRS) for flashcard review and vocabulary tracking.
- A vocabulary analytics dashboard.
- A curated immersion video library.
- Future additions may include grammar explanations and structured courses.

Be French is exclusively focused on French language learning. It is not a general language-learning platform and does not support other languages.

3. Eligibility
You must be at least 16 years of age to use Be French. By using the Service, you represent that you meet this age requirement and that you are not prohibited from using the Service under the laws of your country of residence.

4. Account Registration
To access the Service, you must create an account using a valid email address. You agree to:
- Provide accurate, current, and complete information during registration.
- Keep your login credentials confidential and not share them with any third party.
- Notify us immediately at bverhaeghe2002@gmail.com if you suspect any unauthorized access to your account.
- Accept responsibility for all activities that occur under your account.

We reserve the right to suspend or terminate accounts that we reasonably believe have been compromised, shared, or used in violation of these Terms.

5. Subscriptions & Billing
5.1 Plans
Be French is offered on a subscription basis. We offer both monthly and annual billing plans. Current pricing is displayed at the point of purchase and on our pricing page. We reserve the right to adjust pricing with at least 30 days' advance notice to existing subscribers.

5.2 Free Trial
New users may be eligible for a 7-day free trial of the paid Service. The free trial grants access to all features of the selected subscription plan. At the end of the trial period, your subscription will automatically convert to a paid subscription and your payment method will be charged unless you cancel before the trial ends.

Only one free trial is permitted per user. We reserve the right to verify eligibility and revoke trial access where abuse is suspected.

5.3 Automatic Renewal
Subscriptions automatically renew at the end of each billing period (monthly or annual) unless cancelled before the renewal date. You authorize us to charge your stored payment method for the applicable subscription fee at each renewal.

5.4 Payment Processing
All payments are securely processed by Stripe. By subscribing, you agree to Stripe's terms of service and privacy policy. Be French does not store your full credit card details on its servers.

5.5 Failed Payments
If a payment fails, we will attempt to notify you by email. Access to the Service may be suspended until payment is successfully processed. We reserve the right to terminate subscriptions with repeated payment failures after reasonable notice.

6. Refund Policy
We offer a 14-day money-back guarantee for new subscribers. If you are not satisfied with the Service, you may request a full refund within 14 days of your initial paid subscription charge by contacting us at bverhaeghe2002@gmail.com.

Refunds are not available for:
- Requests made after the 14-day window has expired.
- Subscription renewals (monthly or annual) beyond the first billing cycle.
- Accounts found to be in violation of these Terms.

Refunds for annual subscriptions requested within the 14-day window will be issued in full. Partial refunds for unused time on annual subscriptions beyond the 14-day period are not provided.

Note: If you are a consumer residing in the European Union, you may have additional statutory cancellation rights under EU Directive 2011/83/EU. For digital services where delivery begins during the withdrawal period with your explicit consent, your right of withdrawal may be forfeited upon commencement of the Service. We will inform you clearly at the point of purchase.

7. Cancellation
You may cancel your subscription at any time from your account settings or by contacting us at bverhaeghe2002@gmail.com. Cancellation takes effect at the end of the current billing period. You will retain access to the Service until that date. Cancellation does not entitle you to a refund unless you are within the 14-day money-back guarantee period described above.

8. Acceptable Use
By using Be French, you agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws.
- Attempt to reverse-engineer, decompile, disassemble, or otherwise extract source code from the Chrome Extension or any part of the platform.
- Scrape, harvest, or systematically extract data from our platform, including vocabulary databases, subtitle data, or user progress data.
- Circumvent, disable, or interfere with any security or rate-limiting mechanisms of the Service.
- Share, resell, or sublicense your account or subscription to any third party.
- Use automated tools, bots, or scripts to access or interact with the Service in a manner not intended.
- Attempt to access data of other users or administrative systems beyond your authorized scope.
- Use the Service in any way that could damage, overload, or impair our infrastructure.

Violation of this section may result in immediate suspension or termination of your account without refund.

9. Intellectual Property
All content, technology, and materials comprising the Be French Service, including the Chrome Extension code, dashboard interface, SRS logic, vocabulary database, AI-generated definitions, and branding, are the exclusive intellectual property of Verhaeghe (Be French) and are protected under applicable French and international intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for personal, non-commercial French language learning purposes, strictly in accordance with these Terms.

You retain ownership of any personal flashcard content you create. By creating flashcards or adding content within the platform, you grant us a limited licence to store and process that content solely to provide the Service to you.

10. Third-Party Services & YouTube
Be French operates as an overlay tool on YouTube. Our Service is not affiliated with, endorsed by, or sponsored by YouTube, Netflix or Google LLC. Your use of YouTube remains subject to YouTube's Terms of Service and Community Guidelines. Your use of Netflix remains subject to Netflix's Terms of Service and Guidelines.

Be French relies on the following third-party services to operate:
- Supabase, for database storage and authentication.
- Cloudflare, for API gateway and security.
- Stripe, for payment processing.
- OpenAI and/or Gemini (via Cloudflare Workers), for AI-generated definitions.

We are not responsible for the availability, accuracy, or practices of these third-party services. Their respective terms of service and privacy policies apply to their portions of the Service.

11. Data & Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using Be French, you consent to the collection and use of your data as described in the Privacy Policy.

You have the right to request deletion of your account and all associated data at any time by emailing bverhaeghe2002@gmail.com. We will process deletion requests promptly.

12. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not guarantee that:
- The Service will be uninterrupted, error-free, or free of viruses or harmful components.
- Any specific learning outcomes (such as reaching a particular language proficiency level) will be achieved through use of the Service.
- Subtitle data, translations, or AI-generated definitions will be perfectly accurate at all times.

Be French is a language learning tool. Actual results depend on individual effort, consistency, and prior knowledge. We make no binding promises about language proficiency outcomes.

13. Limitation of Liability
To the fullest extent permitted by applicable law, Verhaeghe Benoit (Be French) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of revenue, or loss of learning progress, arising from your use of or inability to use the Service.

Our total aggregate liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the total amount you have paid to us in the 12 months preceding the claim.

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under French law.

14. Service Availability & Changes
We will make reasonable efforts to maintain Service availability. However, we may occasionally suspend access for maintenance, updates, or unforeseen technical issues. We are not liable for downtime beyond our reasonable control.

We reserve the right to modify, add, or remove features of the Service at any time. For material changes that significantly impact the core functionality you subscribed for, we will provide reasonable advance notice.

15. Modifications to These Terms
We may update these Terms from time to time. When we make material changes, we will notify you via email (to the address on your account) and/or via an in-app notification at least 14 days before the changes take effect. Your continued use of the Service after the effective date of updated Terms constitutes your acceptance of the revised Terms.

If you do not agree to updated Terms, you must cancel your subscription and stop using the Service before the changes take effect.

16. Termination
We reserve the right to suspend or permanently terminate your account and access to the Service at our discretion, with immediate effect and without refund, if we determine that you have materially violated these Terms.

In cases of non-material or first-time violations, we will generally attempt to notify you and give you an opportunity to remedy the situation before taking action.

You may terminate your account at any time as described in Section 7. Upon termination, your right to use the Service ceases immediately.

17. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or the Service shall first be submitted to amicable negotiation. If no resolution is reached within 30 days, the dispute shall be subject to the exclusive jurisdiction of the competent courts of France.

If you are a consumer resident in the European Union, you may also submit a complaint through the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

18. Miscellaneous
Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Be French regarding the Service and supersede all prior agreements.

Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Waiver: Our failure to enforce any provision of these Terms shall not be deemed a waiver of our right to enforce it in the future.

Language: These Terms are drafted in English. In the event of any discrepancy between an English version and any translated version, the English version shall prevail.
